Throttle And Iron LLC

Welcome to Throttle And Iron. These Terms of Service (“Terms”) are a legal agreement between you and Throttle And Iron LLC (“Throttle And Iron,” “we,” “us,” or “our”) and govern your use of:
- Our website at https://throttleandiron.com;
- Our weekly live show and its interactive audience “play-along” features (on-screen trivia, polls, and giveaways you participate in from your device); and
- The Throttle And Iron rider mobile app (“ti-ride-tracker”).
We refer to all of the above together as the “Services.” By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian. By using the Services you represent that you meet these requirements.
2. Your Account
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it current. Tell us promptly at christopher@throttleandiron.com if you suspect unauthorized use of your account.
3. Live-Show Participation, Chat, and User Content
When you participate in our live show or submit content (including live-chat messages, votes, giveaway entries, or other submissions) (“User Content”), you agree that:
- You will not post content that is illegal, harassing, hateful, threatening, defamatory, obscene, infringing, spam, or otherwise objectionable, and you will not impersonate others or manipulate votes, trivia, or giveaways (for example, through multiple entries or automated entry).
- We may moderate, remove, time out, or ban participants and remove or refuse any User Content at our discretion, for any reason, including to enforce these Terms or platform rules.
- You grant Throttle And Iron a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the User Content you submit in connection with operating, promoting, and rebroadcasting the show (including on-screen display and archived recordings).
- Live-show features that run on YouTube are also subject to the YouTube Terms of Service.
Giveaways may have additional rules (eligibility, how winners are drawn, and how prizes are awarded); where posted, those rules also apply. No purchase is necessary to participate unless expressly stated, and giveaways are void where prohibited.
4. The Rider App (“ti-ride-tracker”) — Safety; Use While Riding
The rider app provides ride tracking, maps, and turn-by-turn navigation. Read this section carefully — it concerns your safety.
- Do not operate the app while riding. Set up your route and the app before you begin riding. Do not view, touch, or interact with your device while operating a motorcycle or any vehicle.
- Navigation is an aid, not a guarantee. Maps, routing, and location data may be inaccurate, incomplete, or out of date. Always obey all traffic laws, road signs, and signals, and use your own judgment. Do not follow a route that is unsafe, illegal, or impassable.
- You are solely responsible for safe operation of your motorcycle and for your own conduct. The Services are not a substitute for safe riding practices, proper licensing, protective gear, or attention to your surroundings.
- Location and navigation features depend on your device, GPS signal, network connectivity, and third-party map data (see Section 6), and may not be available everywhere or at all times.
To the fullest extent permitted by law, you assume all risk arising from your use of the app while riding, and Throttle And Iron is not liable for any incident, injury, loss, or damage resulting from your operation of a vehicle.
5. Acceptable Use
You agree not to: (a) violate any law or these Terms; (b) interfere with or disrupt the Services, our servers, or networks; (c) attempt to gain unauthorized access to any part of the Services or other users’ accounts; (d) scrape, harvest, or use automated means to access the Services except as expressly permitted; (e) reverse engineer or attempt to extract source code except where the law permits; or (f) use the Services to infringe others’ rights.
6. Third-Party Services
The Services rely on third parties, including YouTube/Google, Mapbox (maps and navigation in the rider app), and Stripe (payments). Your use of those features is also subject to those providers’ terms and privacy policies. We are not responsible for third-party services and do not control them.
7. Payments and Refunds
If you purchase anything through the Services, payment is processed by Stripe and you authorize the applicable charge. Prices and availability may change. Except where required by law or expressly stated, payments are non-refundable. Purchases made through the Apple App Store or Google Play are subject to those stores’ refund policies, and any refund for an in-app purchase or subscription must be requested through the applicable app store in accordance with its rules.
8. Intellectual Property
The Services, including our name, logos, show content, software, and the look and feel of the website and app, are owned by Throttle And Iron LLC or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services except as expressly allowed.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any location, mapping, or navigation data will be accurate or reliable.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THROTTLE AND IRON LLC AND ITS OWNERS, MEMBERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, INCLUDING THE RIDER APP AND ITS NAVIGATION FEATURES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Throttle And Iron LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms or of any law or third-party right.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 4, 8–11) will survive.
13. Governing Law
These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Dearborn County, Indiana will have exclusive jurisdiction over any dispute not subject to other agreed-upon resolution.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
